This is a great case study on the complicated world of trademark law and the importance of balancing fair use and trademark protection. Initially, I was confused about what exactly distinguished the two dog toy cases, since they both seemed very similar on their facts. But after some more investigation, I believe the difference comes down to a different test that each of the courts used and a respective difference in analysis.
